Booking Terms and Conditions
1 These Terms

1.1 These terms and conditions (the Terms) apply to your Booking (“Booking”). Terms.

 

1.2 In these Terms, references to "We", "Us" and "Our" means Diageo Scotland Limited, a company registered in Scotland with company number SC000750.

2 Bookings

2.1 A Booking must be made by a person aged 18 years or over. Please check carefully before you book and when attending Johnnie Walker Princes Street Bars and carry photographic proof of age. Challenge 25 is in operation at Johnnie Walker Princes Street bars. Children under 18 are not allowed entrance to the Explorers’ Bothy. 1820 Bar and Blue Label room allow Children until 6pm only. From 6pm, the 1820 Bar allows 18 years old and above only. Children under the age of 18 must be accompanied by an adult who is 18 years or older at all times.

 

2.2 A Booking is not complete until accepted by us and deposit paid by customer in order to secure the booking. Our acceptance of your Booking will take place when we email you to accept it. We try to ensure availability is accurate, but errors may occur. If we discover an error in availability for your Booking, we will inform you as soon as possible and we may either cancel the Booking(in which case you will be refunded the full amount) or give you the option of confirming your Booking at another time or date.

 

2.3 The Johnnie Walker Princess Street Hogmanay event (“Hogmanay Event”) shall take place between 7.30 pm – 1.00am on the 31st December 2022 in the 1820 Bar. You are required to make a full payment of £175 per person to secure Your reservation for the Hogmanay Event. A Booking will not be confirmed until full payment is received, which must be at the time of a booking. If no payment is received, the Booking shall be cancelled.  You reserve the right to cancel the Booking up to 14 days prior to the Hogmanay Event and receive a full refund. Subject to availability.

 

2.4 The Hogmanay Event ticket includes Welcome Canapes, Journey of the Flavour Tasting bowls, Smoked Meats and Cheese Charcutier Boards and three drinks (Welcome Drink, Highball and Champagne or Dram) as specified in the advertised menu together with musical entertainment. We reserve the right to provide a substitute to the advertised menu of equal or greater value if the items on the menu are not available for any reason as determined by Us in our sole discretion.

 

2.5 If you or any member of your party has any special requirements (including dietary) and allergies, please raise these when Booking and on arrival at the venue and we will endeavour to address your query. There can be no guarantee that requirements can be met if only notified to Us after you have completed your Booking.

A discretionary 10% service charge will be added to your bill.

3 Attending Johnnie Walker Princes Street Bars

3.1 We reserve the right to conduct security searches on entry and confiscate any item which, in Our reasonable opinion, may cause danger or disruption to other visitors or venue.

 

3.2 Whilst attending the venue, you must at all times comply with all safety announcements, venue rules and directions given by Our staff and security personnel from time to time.

 

3.3 We reserve the right to refuse admission or require you (and other members of your group) to leave the Johnnie Walker Princes Street Bars in reasonable circumstances, including for health and safety reasons, if You breach any of the Johnnie Walker Princes Street Bars rules, if You are involved in any abusive, threatening, drunken or other anti-social behaviour, if You are acting under the influence of, or carrying, any illegal or prohibited substances or if You make unauthorised audio, video or photographic recordings. No refunds will be given to persons who are refused entry or who are required to leave due to their own behaviour as suggested in, but not limited to, the examples above.

 

3.4 Due to limited space, you may not be able to come into the Johnnie Walker Princes Street Bars until your table is ready, please plan your journey accordingly.

 

3.5 Terrace is not bookable online. Access to terrace is weather permitting and subject to availability.

 

3.6 Smart casual attire is our dress code policy. No costumes or sporting attire are allowed.

 

3.7 From time to time We, or other authorised third parties, may carry out photography or other recordings at the Johnnie Walker Princes Street Bars and any images or recordings may feature visitors. You consent to the use of such images by Us in any media in connection with advertising or promotions and acknowledge that the copyright in such images rests with Us and/or any authorised third party.

 

3.8 Cameras may be brought into the Johnnie Walker Princes Street Bars for private purposes only, however, the use of photographic and recording equipment may be prohibited in certain areas within the Johnnie Walker Princes Street Bars. We shall notify you of such restrictions prior to entering such areas. We reserve the right to confiscate and destroy unauthorised recordings, films or similar items. We will not be liable for any loss, theft or damage to confiscated items.

 

3.9 You should take care of any personal property that you may bring with you and in no circumstances should you leave it unattended. We accept no responsibility for personal property.

4 Cancelled Bookings/ Refunds

4.1 We may cancel a Booking for operational reasons or for causes beyond Our control and you must advise your party of any changes. We will notify you as soon as possible (using the email address you provided) where we have cancelled a Booking.

 

4.2 If a Booking is cancelled by Us, you shall be entitled to a refund from Us for any deposit paid. If a Booking is cancelled by You at least twelve (14) days prior to the Hogmanay Event You shall receive a full refund. No refunds will be made to you if you cancel a Booking less than twelve (14) days prior to the Hogmanay Event. For the avoidance of doubt, no refunds will be made if the Hogmanay firework display operated by Edinburgh’s Hogmanay is cancelled.

 

4.3 We require a minimum of 24 hours’ notice to amend or cancel your reservation for 1820 Bar or Explorers’ Bothy in order to get a full refund. For Blue Label Room reservations we require at least 48 hours’ notice to amend or cancel reservation, without losing your deposit payment. You can amend your booking by contacting us on 0131 376 9494 or via email at jwps.f&b@diageo.com. We may cancel a Booking for operational reasons or for causes beyond Our control and you must advise your party of any changes. We will notify you as soon as possible (using the email address you provided) where we have cancelled a Booking.

 

4.2 If a Booking is cancelled by Us, you shall be entitled to a refund from Us for any deposit paid. 

 

4.3 Refunds shall only be made to the person who made the Booking and, when possible, be made using the same method as was used to make the Booking.

 

4.4 Personal arrangements including travel and accommodation relating to your visit to our site are at your own risk. We shall not be responsible for any costs or expenses relating to any other services that you may have arranged.

5 Liability

5.1 We do not accept any liability for any losses or claims arising from any inability to access the website or any interruption or any failure to complete a transaction or Booking.

 

5.2 We do not accept any liability for the acts or omissions of third parties. However, we do not exclude or limit in any way Our liability to you for death or personal injury caused by Our negligence or breach of duty or the negligence or breach of duty of our employees, for fraud or fraudulent misrepresentation or in any other way where it would be unlawful to exclude or limit liability.

 

5.3 If We fail to comply with these Terms or fail to use reasonable care and skill in providing the Booking, we are responsible for loss or damage you suffer that is a foreseeable result of our failure, but we are not responsible for any loss or damage that is not foreseeable or for any business losses set out in paragraph 5.4. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Booking was made, both we and you knew it might happen.

 

5.4 If you are a business, we are not liable for business losses. Subject to paragraph 5.2, we will have no liability to you (whether in contract, delict (including negligence), tort (including negligence) or otherwise) for any loss of profit, loss of business, business interruption, or loss of business opportunity (in each case whether such loss is direct or indirect).

6 Other important terms

6.1 Any Booking made in breach of these Terms shall be void and any person making such Booking shall be refused entry without refund or compensation.

 

6.2 We will process the personal data collected in connection with your Booking in accordance with our Privacy Statement at the Diageo Privacy and Cookie notice. If required, we may share your contact details with NHS Test and Trace.

 

6.3 You accept full responsibility for all contact information on your customer account and must ensure it is kept up-to-date. We accept no responsibility for information not received by you due to out-of-date contact information. Please be aware that your email filter settings may treat Our emails as spam or direct them to your junk folder.

 

6.4 A Booking does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the Booking Confirmation email.

 

6.5 If We delay or fail to enforce any of these Terms it shall not mean that we have waived our right to do so.

 

6.6 This contract is between you and Us. No other person shall have any rights to enforce any of its terms.

 

6.7 We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and will ensure that the transfer will not adversely affect your rights under the contract.

 

6.8 Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

 

6.9 This contract amounts to the entire understanding between you and Us in relation to your order and it will not be modified unless we both agree.

7 Laws and Disputes

7.1 These Terms are governed by English law and you can bring legal proceedings in respect of your purchase in the English courts. If you live in a part of the UK which is not England, you can choose whether to bring legal proceedings in respect of your purchase in the courts of the part of the UK where you live, or the English courts.

 

7.2 Any complaints should be notify to Us in the first instance to JWPS.F&B@diageo.com. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to use alternative dispute resolution.
